Terms of participation in organized trips

General terms of participation in an organized trip

Under Presidential Decree 7/2018, in application of EU Directive 2015/2302

Please read carefully the following General Terms of Participation, which are an integral part of the organized tour contract, as well as any information and recommendations you receive, before signing up for one of our organized tours. Participation in any organized tour of our travel agency requires careful study of the program of the specific tour and means the unconditional acceptance by the traveler/tourist of the General Terms of Participation, in accordance with Presidential Decree 7/2018. Therefore, you enjoy all the rights provided by the EU for these packages.

The General Terms of Participation contain general information, as well as the rights and obligations of the two contracting parties in the organized trip, while with regard to the specific information (destinations, prices, departure and return days and times, means of transportation, accommodations, visits, etc.) that pertain to each organized trip separately, you must consult the program and price list in effect at the time. The travel programs are valid for the period indicated on the relevant forms or on the Site.

1. GENERAL

The information, data, and recommendations contained in the General Conditions of Participation have been verified by our office for their validity and accuracy, are of a general nature, and apply as is, unless something more specific or different is stated in the program of each trip. The programs, including the current price list, are valid for the period indicated in them. The information and details of the travel programs may change due to unforeseen changes in conditions. In this case, you will be notified immediately in the most appropriate way, and therefore we must have all your contact information, for which you are solely responsible. Seat changes on the bus are not made during the journey, except for international trips.

The scheduled stops of the tour can be modified upon consultation between the Tour Leader-Conference and our Office. Our office reserves the right to change the size of the buses depending on the number of participants.

2. REGISTRATION - PARTICIPATION IN ORGANIZED TOURS

Registration is done by visiting our offices or by correspondence (electronic), telephone, provided (in order to secure places in the specific trip):

1. Payment of the advance (50%) or the full amount, in cash, by credit/debit or prepaid card, or by bank transfer to the travel agency.

2. Unconditional acceptance and compliance with these General Terms. For a valid registration, the specific trip, with the departure and return dates and any other distinguishing features, must be listed on the payment receipt for the advance payment or prepayment.

The right to participate in the trip is secured by paying the full value of the trip and the related expenses 7 full days before departure.

Any failure to pay the full value of the trip within the specified time allows our Travel Agency to cancel the reservation and possibly require cancellation fees, in accordance with the cancellation terms provided herein. The contracting party, who represents the family or group, is obligated to inform all fellow travelers represented by him/her about the details and terms of the trip. Through a third party, participants have the same obligations as the representative who registered them for the trip, and the travel agency makes all relevant information available to them upon request.

The tourist services provided to you and the related costs are detailed in the Package Travel Contract. If you cannot be present in person (booking by phone, email, etc.), you will receive the Contract by email (in this case, you have the right to withdraw from the contract within 14 days from the date it was sent to your email, taking into account the related cancellation fees mentioned in Article 11 below).

Our Tourist Office is not responsible for the days and hours of operation of markets, museums, and archaeological sites.

3. TRAVEL PRICES - EXTRAS ETC.

The value of the trips is stated in our current price list. Fare prices are calculated on the day the price list is issued, based on the cost of each trip's services, the cost of fuel or other energy sources, applicable fares/surcharges, all types of taxes or fees, the exchange rate of foreign currencies relative to the € (Euro), and any other cost factors (e.g., minimum number of participants, etc.). Our Tourist Office, after exhausting every possible means of prediction, reserves the right to adjust prices when the above cost factors change.

Specifically, the price of the trip can change up to 20 days before the start of the travel services. The specific increase in price will be communicated to the traveler in a detailed, clear, understandable, and discernible manner.

In the event of a significant price increase (i.e., more than 8% of the trip's value) for the above reasons, the traveler may cancel the contract without paying a cancellation fee and be refunded the exact amount paid. If the traveler cancels the package tour contract for the above reason, the traveler may accept another package of equivalent or higher quality.

It is the traveler's obligation to notify our Travel Agency in writing of any decision within a reasonable time period, which in no case can exceed 3 days from the moment the price increase is notified to them.

If the traveler does not respond in writing within the above time limit, our Travel Agency is obligated to cancel their participation and return all the money they have paid without any further obligation, taking into account the related cancellation fees mentioned in Article 11 below.

Additionally, our Tourist Office has the right, for a certain period of time or for a limited number of seats, to pre-sell seats at more favorable prices, with special cancellation fee terms.

Children's rates vary depending on the case, from free accommodation without food at hotels and ships to a small discount (for ages 2-11, usually, and only when two adults pay for the same room/cabin).

Rates do not include accommodation tax and municipal taxes. In Greece, the accommodation tax per room/suite and per night is: 3-star hotel: €1.50, 4-star hotel: €7.00, 5-star hotel: €10.00. The new residence tax of Law 4389/2016, which as of 01/01/24 is called Climate Resilience Fees

4. OBLIGATIONS - RESPONSIBILITIES OF THE TOURIST AGENCY

Our Tourist Office is obligated to coordinate and execute the trips it offers to travelers in the best possible way. However, having exhausted every possibility of prediction and care, it is not responsible for the wrong actions and omissions of third parties and their associates, as well as for extraordinary situations, such as cancellations, delays, or changes in the itineraries of various means of transportation (ships, buses, trains, etc.) or in the event of a blockade ("embargo") of areas due to terrorist actions, strikes, and other causes of force majeure.

Our Tourist Office cannot predict or control any delays of scheduled ships due to technical, meteorological, or other reasons (and therefore travelers should not plan important personal activities or combine other movements on the days of departures/arrivals).

It is noted that our Tourist Office is not able to predict or control circumstances that are outside its sphere of influence and may lead to the cancellation of the trip or damages due to non-performance or improper performance of the agreed-upon services of the trip.

Typical examples of such cases are: strikes, accidents, illnesses, epidemics, organic disorders due to local conditions, altitude, climate, due to meals not included in the trip's program or due to inadequate sanitary conditions from external factors, injuries or hardships due to war, coups, terrorist actions, hijackings, earthquakes, weather conditions, fires, epidemics, toxic infections, and any other state of necessity or force majeure.

In the above cases, our Tourist Office bears no responsibility for any damage caused by them, but will exhaust every effort to support and care for travelers in every way, without this constituting a responsibility or obligation to cover the related extraordinary expenses, which, as in cases of force majeure, must be covered by the travelers themselves.

Reasonable complaints during the trip must be reported immediately and on the spot to the tour guide (or, in his absence, to our office), and to the provider of the specific service, in writing. If the problem identified cannot be resolved on the spot, after your return from the trip, you must submit any relevant complaints in writing to our office within 7 working days, along with any documents or other evidence you have to justify it. After the 7-day period, our Tourist Office is not obligated to respond to any claim. If damages arise due to the non-performance or inadequate performance of organized tour services, the compensation to the customer is limited to what is stipulated by the international conventions that bind the country and govern such services. Specifically: The compensation arising from the non-performance or inadequate performance of the organized trip benefits is limited to twice the value of the individual trip price. To make an organized trip possible, a minimum of 20 (twenty) participants is required (not including children under 12 years old. If this number is not met, our office reserves the right to cancel the trip 7 days before the tour departs, and must inform the customers who had signed up for it and return the money they had paid, without any other obligation. Our office only offers the services mentioned in the program descriptions of the organized trips. Any optional benefits are available for an additional fee, if they can be implemented. Our office is not responsible for any optional services, which are mainly provided by local entities. After the completion of your trip, our office will issue the tax documents required by law, which will be collected on the bus.

5. OBLIGATIONS – RESPONSIBILITIES OF TRAVELERS

Because organized trips usually involve other people, appropriate social behavior and absolute compliance by travelers with the trip schedule and the instructions of the tour leaders or guides are necessary, as well as their timely arrival at the gathering points for the various services of the program (transportation, tours, excursions, meals, etc.). If the traveler's delay or inconsistency results in the loss of a tour, transportation, or other service offered, the traveler must reconnect with the group at their own expense and responsibility, without the right to a refund for the lost service or for the entire trip if they are unable to reconnect.

Our Office will make every effort to assist him, without having or assuming any obligation or responsibility. 

You should be at the departure points at least half an hour before departure.

If a traveler cancels their trip at their own decision and leaves the group, they are not entitled to any further service or compensation, and the responsibility and costs of any movement outside the group are solely theirs. In the same way, our office is not liable for organized travel services that were not provided to the traveler due to his or her own negligence or responsibility, due to illness or sudden accident. If a customer is unable to participate in the organized trip for which they have reserved a place, they may assign (by informing our office in writing) their reservation to another person who meets the requirements for participation in the trip, no later than 7 days before the start of travel services. For sea transportation, the corresponding deadline is 10 working days before departure. The substitute (assignee) and the original participant (assignor) are jointly and severally liable to our Tourist Office to pay to it any outstanding balance of the amount, as well as any additional costs of this assignment. It is clarified that any change must be exactly within the same framework and will be accepted if all service providers in the organized trip (hotels, etc.) accept the changes. If a replacement (substitute) cannot be found, the money can be credited to a later trip within a 3-month period. 

Travelers are responsible for the actions of the children they are accompanying and must supervise them at all times during the trip for their safety and behavior.

If the trip is interrupted due to quarantine or any hospitalization of the participant or for any further public health precautionary reason either of the destination country or any intermediate country, LP Travel Services bears absolutely no responsibility towards the traveler for not providing part or all of the agreed services, having no obligation for any kind of compensation or replacement of unprovided service at a later time.

6. HOTELS-ACCOMMODATIONS/SHIPS AND OTHER TRANSPORTATION MEANS

All information regarding the categorization or classification of hotels and accommodations mentioned in our organized or sold travel programs is in accordance with the current legislation of each country for the tourist classification of hotels and accommodations, which may differ from country to country. Most hotel rooms have two beds or a queen-sized bed. Triple rooms are essentially double rooms with an extra bed. They are usually not very comfortable, and the extra bed may be smaller than the regular ones or a sofa or a fold-down bed. Rooms are usually handed over by the hotel between 14:00-16:00 and are available to tenants until 10:00-12:00 on the day of departure (depending on the policy of each hotel). If you wish to check in earlier or check out later, you must pay the relevant surcharge (if there is availability). If, due to unforeseen difficulties, the tour organizer is forced to change hotels to another of the same or higher category, the Travel Agency is not obligated to provide any other compensation to the travelers. On coach trips for Greek tours, seats are assigned in the order of registration and are not changed during the trip, while on foreign tours, they are changed daily. Smoking on the coach is prohibited. 

The duration of a full-day visit/trip does not exceed nine (9) hours in total, always calculated from departure to return to the hotel.

We recommend that you do not leave your personal belongings (e.g., mobile phones, etc.) exposed and that you constantly monitor them in any space (hotel, ship, etc.). Specifically, in hotels, it is international practice not to take responsibility for money or valuables left in the room. For such cases, there are often small safes.

7. PASSPORTS, ENTRY VISAS & HEALTH DECLARATIONS

 

The passport must be valid for the time after the scheduled return date determined by the destination countries. Schengen countries accept new-style police ID cards with Latin characters.

Our Tourist Office provides all the necessary information regarding travel and other documents required for Greek citizens for any trip and destination and their issuance or/and certification, but (even if it provides some assistance in the relevant procedure) it is in no way responsible for any non-issuance or non-certification of these by the competent authorities, to which the traveler must turn, nor is it responsible in case the validity of the visa is less than the duration of the trip (i.e. the dates do not coincide) or in case a couple of travelers have different nationalities among them, except Schengen.

 Especially citizens of other countries who hold foreign passports must inform the tourist office and contact the consular authorities of their country and the countries they will visit to check if they need an entry visa or any other documents for the countries they will pass through or travel to, as well as for their re-entry into Greece or the country from which they started. Any failure to obtain timely issuance or visa of your travel documents does not justify the cancellation of your participation in the trip without incurring cancellation fees. Each traveler is responsible for the validity and authenticity, the securing and safekeeping of their travel documents required for their trip. The traveler is responsible for safekeeping their tickets and all travel documents throughout the trip. 

The parent who is traveling alone with a minor child must bring a certified English-language authorization from the other parent who is not traveling. A similar procedure is followed in cases where the minor is not accompanied by a parent/guardian, in which case a notarized authorization from both parents is required. In any case, our office is not responsible if the local authorities do not accept their entry into their country.

The traveler is required to comply with national provisions and regulations as well as the instructions of national authorities. Our office is not liable in case the traveler faces criminal charges, is summoned to appear before an authority, is arrested by local authorities, etc.

Due to the confidentiality of medical personal data - sensitive personal data - the responsibility to contact

The responsibility for notifying the relevant health authorities rests solely with the traveler. The traveler is required to be informed in a timely manner by local health offices about the health regulations of each country, as well as about the vaccines or medications that may need to be obtained. Customers with health issues must obtain their doctor's approval to travel, providing a medical certificate or a sworn statement that they can travel safely. Our office is not responsible for any illness, injury, loss of life, accident or other health emergency that may occur during the trip. In the event of such an occurrence, our office will attempt to support the affected party to the extent possible, but it is not obligated to cover any related expenses or change the travel itinerary, which will continue as planned.

8. INSURANCE

Our office has a liability insurance policy with an insurance company for each tour we organize. The policy number and the insurance company details are listed on the organized trip contract. The insurance policy addresses, among other things, the case of the organizer's insolvency, covering all travelers regardless of their place of residence, place of departure, or place of sale of the travel service. Additional travel insurance is provided for accident-related accident, medical/hospital expenses, lost and delayed luggage, travel acceleration expenses, as well as the repatriation of travelers due to injury or illness and other coverage, for individuals who have not exceeded the age of 75. On the other hand, for individuals over 75 years old, there is a specific framework for travel insurance coverage, which is limited to the following cases: Repatriation expenses only in the event of an accident or death, loss of luggage, personal liability of the traveler.

9. LUGGAGES

Luggage is transported at the owner's risk and responsibility, regardless of whether or not there is an accompanying representative of our office. In the event of damage or loss, the relevant international treaties for each mode of transportation and for hotels apply, and liability in such cases is limited to what is provided for in those treaties. Our office is not responsible for the contents of the luggage.

10.  CANCALLATIONS

 

Cancellations from the traveler's side are only made in writing to our office and, regardless of the date of the booking. Specifically: a) In case of cancellation of the excursion 11 days before departure, 100% of the money is refunded b) In case of cancellation of the excursion from 10 to 7 days before departure, the booking is transferred to another person under the conditions mentioned in Article 6 of the General Terms of Participation) c) In case a substitute (assignee) cannot be found, the money is credited to a later excursion within a 2-month period d) In case of cancellation of the excursion from 6 days up to the day of departure, the entire amount is withheld.

Charges are made regardless of the time of registration or whether the corresponding amounts have already been paid by the travelers or not. If one of the two people who have chosen to stay or are staying in a double room cancels their participation, they will pay the corresponding cancellation fees. Since the above cancellation fees do not equal 100% of the total trip value, the person who will travel in the end will also pay the difference of their room, as they will have to stay in a single room. In the event of a cancellation of the trip by our Tourist Office and if the time of booking allows it, the following deadlines for informing the Traveler are followed:

a) 7 days before the departure date, when the trip lasts more than six (6) days.

b) 5 days before the departure date, when the trip lasts between four (4) and five (5) days.

c) 3 days before the departure date, when the trip lasts between two (2) and three (3) days.

d) 48 hours when the trip lasts one (1) day (Day trip).

11.  REGULATION OF DIFFERENT ASPECTS

Our Travel Agency and the traveler are committed to resolving in good faith any disputes that may arise during the performance of the package travel contract. If a friendly resolution of the dispute is not possible, the courts of Chalkida are responsible.

10.  CANCELLATIONS

Cancellations of participation by the traveler are made only in writing to our office and, regardless of the date of the reservation. Specifically:

a) In the event of cancellation of the tour 11 days before departure, a 100% refund will be issued.

b) In the event of cancellation of the tour 10 to 7 days prior to departure, the reservation will be transferred to another person under the conditions stated in Article 6 of the General Terms of Participation.

c) If a replacement (substitute) cannot be found, the money can be credited to a later trip within a 3-month period.

d) In the event of cancellation of the tour from 6 days up to the day of departure, the full amount is withheld.
